Terms of Service

1. Agreement to These Terms

These Terms of Service ("Terms") govern your access to and use of FlipFynd, including our website, account features, scan tools, pricing data, billing flows, and related services (collectively, the "Service"). By creating an account, subscribing, uploading content, or otherwise using the Service, you agree to these Terms.

If you use FlipFynd on behalf of a business or another person, you represent that you have authority to accept these Terms on their behalf.

2. What FlipFynd Does

FlipFynd helps resellers scan physical media such as DVDs, video games, and books, identify titles, and compare market signals such as active listings, sold listings, average prices, and sell-through rates. Results may be generated using image processing, AI services, eBay data, and third-party scraping or data providers.

FlipFynd is a research tool. It does not guarantee resale value, demand, profitability, availability, title identification accuracy, or the outcome of any purchase, sale, or marketplace listing.

3. Accounts and Security

You must provide accurate account information and keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must promptly notify us at hello@flipfynd.com if you believe your account has been accessed without authorization.

4. Subscriptions, Billing, and Cancellation

Some features require a paid subscription. Prices, plan limits, and included features are shown on the pricing page or checkout flow and may change from time to time. Subscription billing is processed by Stripe or another payment processor, and your use of payment features may be subject to that processor's terms.

Subscriptions renew automatically unless cancelled before the renewal date. You can manage or cancel your subscription through the account or billing portal when available. Except where required by law or expressly stated at checkout, payments are non-refundable and partial billing periods are not credited.

5. User Content and Scan Data

You retain ownership of images, scan inputs, titles, notes, and other content you upload or provide to FlipFynd ("User Content"). You grant FlipFynd a limited, worldwide license to host, store, process, transmit, display, and analyze User Content as needed to operate, secure, troubleshoot, and improve the Service.

You are responsible for ensuring you have the rights needed to upload User Content. You must not upload unlawful, harmful, infringing, sensitive, or private content that you are not authorized to share.

6. eBay and Third-Party Services

FlipFynd may connect to or display information from third-party services, including eBay, OpenAI, Stripe, Resend, Mailchimp, Crawlbase, Oxylabs, ScraperAPI, cloud hosting providers, and analytics or infrastructure providers. FlipFynd is not owned by, endorsed by, or affiliated with eBay unless expressly stated.

Third-party data can be incomplete, delayed, unavailable, filtered, or inaccurate. You are responsible for verifying important information before making buying, pricing, tax, legal, or business decisions.

7. Acceptable Use

You agree not to misuse the Service. This includes attempting to bypass plan limits, rate limits, billing controls, authentication, or security measures; reverse engineering or scraping FlipFynd; uploading malicious code; interfering with the Service; infringing intellectual property rights; using the Service for unlawful activity; or reselling, sublicensing, or commercially exploiting the Service without our written permission.

8. Availability and Changes

We may modify, suspend, or discontinue parts of the Service at any time. We may also update models, data providers, plan limits, pricing, workflows, and features. We are not responsible for losses caused by downtime, provider outages, marketplace changes, data source limitations, or unavailable features.

9. Termination

You may stop using FlipFynd at any time and may request account deletion by contacting us. We may suspend or terminate access if we believe you violated these Terms, created risk for FlipFynd or others, failed to pay fees, or used the Service in a harmful or unlawful way.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.

11. Limitation of Liability

To the maximum extent permitted by law, FlipFynd and its owners, operators, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost data, or business interruption arising from or related to your use of the Service.

To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid to FlipFynd for the Service in the three months before the event giving rise to the claim, or USD $100 if you have not paid us.

12. Indemnity

You agree to indemnify and hold FlipFynd harmless from claims, damages, losses, liabilities, costs, and expenses arising from your User Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

13. Changes to These Terms

We may update these Terms from time to time. If changes are material, we may provide notice through the Service, by email, or by updating the effective date above. Your continued use of the Service after updated Terms are posted means you accept the updated Terms.
